Who Can File a Chapter 13?

Any Individual or married Couple can file a Chapter 13 so long as they meet some basic requirements. First and foremost, they must be able to fund a Chapter 13 plan. This means that after all of the basic living expenses of the Debtor are paid, there is money left over to pay a Chapter 13 plan. If the Debtor does not have enough remaining funds to pay the Chapter 13 Plan, the Case will not continue. Secondly, if the Debtor received a Discharge in a prior Chapter 13, they must wait 4 years after the date of the prior filing before they are eligible to receive a Discharge in a new Chapter 13.
